There’s a good reason why standard conditions exist: it’s because they have been carefully written for the construction industry in a way that fairly balances the risks between the Employer and the Contractor.

It’s no secret that Employers often modify standard conditions of contract beyond recognition. These modifications shift a lot of the cost, time and quality risks to the Contractor.

If a Contractor qualifies these amended conditions during the tender phase, they risk being disqualified on the basis of a non-compliant bid. Although profit margins are tight, payment terms are lucrative, and they need the job to avoid idle resources elsewhere.

Employers also often make other amendments including omitting a provision for escalation in contract price and stripping the Engineers of their powers, particularly those associated with time extensions and prolongation costs.
