Construction is an industry with inherent risks, with projects involving long term commitments in a fast-changing environment.

The difficulties inherent in civil engineering and building projects frequently cause the expectations of the contracting parties to go unfulfilled. Consequently, goodwill evaporates and disputes proliferate. 

Disputes are costly, distracting to the management, and contaminate the parties’ working relationships. CMA strives towards an early, inexpensive and satisfactory solution to a potential dispute using alternative dispute resolution mechanisms, such as mediation for example. 

However, when disputes are unavoidable CMA carries out an objective assessment of the likely outcome of the dispute, whether in arbitration or litigation. Further, CMA carries out an assessment of the cost involved in resolving the dispute, including cost of the institution administering the dispute, cost of the arbitrators, cost of counsel, and cost of expert witnesses.

CMA can work with the party’s counsel to draft pleadings, select the appropriate witnesses, and attend evidentiary hearings. If appropriate, CMA can suggest an approach for an amicable settlement.

In the event of a meritorious claim, and given the exorbitant cost of disputes, and in the event that funding is of concern, then CMA may be able to secure third-party litigation funding.
